Read these terms of buying usage carefully. By purchasing products created by MediaGroup LLC, you confirm that you have read these Terms of Usage and accept them. (We have the right to make changes to the current Terms of Usage without prior notification)
The following terms used in this document:
“Customer”, “You” and “Your” refer to you, as a person visiting this website and accepting these Terms of Usage.
“Company”, “Our”, “We”, “Ours”, “Us” refer to our company.
“Party”, “Parties” or “Us” refer both to the Customer and to the MediaGroup LLC company.
We provide you with a non-exclusive and limited license in order to use the products created by MediaGroup LLC and distributed on the websites https://clearfy.pro or https://ru.clearfy.pro. Both websites are governed by these Terms of usage (“license”). We can limit or permanently stop providing the service in case of violating these Terms.
If you disagree with these Terms, you should stop using our products.
- LIABILITIES OF THE PARTIES
Under no circumstances shall MediaGroup LLC be responsible for any direct, indirect, special or incidental damages (including data or profit losses) occurred while using the materials of this website, even if the authorized representative was informed of potential risks.
If you need to use any website materials for maintenance, repair, or fixing the equipment or data you accept all risks by default.
- LICENSE
We’ve created our free software for the content management system named “WordPress” and distribute it under the GNU GPL v2 license. However, our paid versions of products are distributed under the commercial license.
2.1. Duration of license and renewals
The license for our free products doesn’t require any activation key, and its duration is not limited. You can get updates and technical support without limits.
The license for paid products is valid for one year since the purchase date. In this case, you need a valid and active license key to get updates and technical support. You can renew the key before or after the expiration date.
2.2. Software update
Updates for free products are free of change and not limited.
Updates for paid products are paid and provided for one year. To download updates of paid products you’ll need a valid license key.
2.3. Technical support
You can get a technical support for free products anytime. However, it is not a priority task. In case of many support requests, we reserve the right to leave such requests without reply.
Technical support for paid products is provided within one year since the purchase date. If you want to extend priority support, you should update the license key and re-purchase access to priority support, or purchase a new license for the necessary plugin.
Users with a commercial license have only the right to get priority support within 23-48 hours.
We don’t provide technical support in the installation, configuration of third-party plugins, scripts, templates or WordPress administration.
If you want a technical support, then make sure to have the latest versions of our products, WordPress or other plugins from our website. Our company doesn’t provide guarantees nor support of outdated or modified versions of our software.
MediaGroup LLC provides the products “as-is”, which means the products solve specific tasks listed in the description.
We are not responsible for how our plugin works together with third-party software.
You are responsible for creating a backup copy of your website before contacting the technical support team or gaining them access. Also, you are fully responsible for any content losses or downtime regardless of having a temporary or production website.
- COMPATIBILITY AND UPDATE
3.1. Plugin compatibility and update
We update our products on the regular basis, so they are compatible with the latest WordPress version. The MediaGroup LLC developers update the software within 30 days after the new CMS release.
We don’t guarantee that our software is going to work with old WordPress versions correctly.
3.2. Browser compatibility
Our plugins support all modern web browsers, including (but not limited to) Firefox, Safari, Chrome (all for PC ↦ Mac) ↦ Internet Explorer.
We try to provide compatibility with each of these browsers. However, we can’t guarantee correct work with all previous browser versions. If the browser doesn’t support certain web standards, then we are not responsible for the correct work of our products.
- OWNERSHIP AND RESPONSIBILITY
You can’t claim intellectual or exclusive ownership of any products created by us – modified or not modified. All products belong to MediaGroup LLC. Under no circumstances, our entity can be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential losses, caused by our product’s usage or inability of usage.
- GUARANTEE
Our products are distributed “as-is”, without any guarantees – expressed or implied. We don’t guarantee that templates and plugins will work with all browsers, nor do we guarantee that our products will work with all WordPress versions. We don’t guarantee compatibility with additional third-party plugins, scripts, and applications.
- MODIFICATIONS AND COPYRIGHT INFORMATION
You have a right to make all necessary changes to our products based on your specific needs. You are not allowed to remove our credit tags (copyright lines) from both free and paid products. All our products, even the free ones, are protected by copyright.
- SERVICE RULES
You agree not to use our services to:
- upload, post, send by e-mail, transfer or anyhow distribute materials considered as illegal, harmful, threatening, offensive, harassing, sensitive, defamatory, vulgar, obscene, slanderous, invasive in terms of the privacy, hate or racial, ethnic or other discrimination;
- impersonate any other person or organization, including by not limited to, official representatives, managers or receiving party, or misstate or mislead your affiliation with a person or legal entity;
- update, post, send by e-mail, transfer or anyhow give access to any content you not entitled to provide under any law or contractual relationship (for example, insider information or confidential information disclosed in business relations or non-disclosure agreements);
- upload, post, send by e-mail, transfer or anyhow distribute materials and content violating any patent, trademark, trade secret, copyrights or other intellectual or ownership rights (“Rights”) of any parties;
- upload, post, send by e-mail, transfer or anyhow distribute materials with viruses or other computer code, files or applications aiming to corrupt, destroy or limit the functionality of any software or hardware or telecommunications equipment;
- DELIVERY
After receiving your payment, we will send all product information to the associated e-mail address. It may take up to 24 hours but usually happens within a few minutes. If you don’t get the e-mail from us after that period, please, contact us.
- PRICE CHANGES
MediaGroup LLC has a right to change or discontinue – temporary or permanently – the subscription (or any part of the subscription) anytime with or without notification. We have a right to change prices on our products anytime without a prior notification.
- CHANGES IN TERMS OF USAGE
MediaGroup LLC can change these Terms of Usage anytime. When we make any significant changes in these Terms, we will notify you by posting a message on our website. Updated versions of these Terms will be posted on our website and become effective immediately.
